This website is provided to you, our client, under the condition you will accept all Terms and Conditions included herein, without reservations and amendments. Use of this website presupposes your agreement to all of these Terms and Conditions. If you do not agree with these Terms and Conditions, in whole or in part, you may not use this website and should leave it immediately.
GENERAL TERMS
Accuracy and validity of the information and data contained in the section Terms and Conditions have been verified by “The Corfu Experience”, exactly at the time they were prepared.
“THE CORFU EXPERIENCE” – TERMS AND CONDITIONS
GENERAL CONDITIONS OF PARTICIPATION
The General Conditions of participation set out herein (hereinafter referred to as the “Terms of Participation”) govern the obligations and rights of any entities or individual persons (hereinafter referred to as “Travelers”) wishing to purchase and participate in “Private Thematic Tours”, or in “Small Group Tours” organized by the company operating under the brand “The Corfu Experience” (hereinafter referred to as the “Company”).
The “Luxury Private Tours” and the “Small Group Tours” hereinafter referred to as “Tours”.
Before purchasing any of the “Luxury Private Tours”, or “Small Group Tours” please make sure that you have read carefully and fully understand the “Terms of Participation”. Purchasing any of the “Tours” means that you unreservedly accept in full, the following “Terms of Participation”, as well as the Special Terms.
GENERAL TERMS
The “Terms of Participation” include any general information as well as all rights and obligations of the “Travelers”, which form an integral part of the “Tours”. The special terms, information, and details of the “Tours”, (i.e., destinations, itineraries, prices, days, and hours, etc.) are set out in detail in the section the “Tours” of this web site.
It should be noted that the information and details of the Terms of Participation regarding the content of any “Tour”, as well as the information thereon are of a general nature and are valid, unless otherwise provided in any of the “Tours”.
Any information, data and recommendations in the Terms of Participation were confirmed at the time this text was written as to their validity and accuracy. Any “Tour”, that may exist in printed form or being available on the “Company’s” website, including the prices applying from time to time, are valid for the period explicitly mentioned therein.
This unit contains the Terms of Participation of the Company in the Greek language. In case of any discrepancy or disagreements between any sections contained in the Greek and English or any other language translations, the provisions contained in the Greek document shall prevail.
“THE CORFU EXPERIENCE”
The registered offices of the Company “The Corfu Experience” are in Corfu, Greece, at Sotiros 10 Street. The Company is duly registered in the Records of Tourist Enterprises of the Ministry of Tourism under number ION 1014-19/07/2021. The Company organizes and sells “Tours”, on Corfu Island only and acts as the organizer – coordinator of each visit, tour, transfers etc. provided for each particular “Tour”.
LUXURY PRIVATE TOURS & SMALL GROUP TOURS
Luxury Private Tours
The “Luxury Private Tours” are organized tours both to known, but mainly to unknown places on the Island of Corfu, related to culture, traditions, folklore, customs, unique local products, or the daily life of the local people. The purpose of the “Luxury Private Tours” is for the “Travelers” to experience from close all the above, not only to learn about them but also to participate actively.
“Luxury Private Tours” are private tours organized by the “Company” based on the interests and preferences of “Travelers”, who after having answered a short questionnaire, plan the schedule, the routes, and the duration of their private tour on their own. After “Travelers” having sent their request, the “Company” will send within a few hours the proposed schedule, which, among other things, will include the cost analysis of the whole tour.
The “Luxury Private Tours” are totally private since they are offered to groups, clubs, or families of up to 18 (eighteen) persons in total, and the participants know each other. In this agreement they are represented by the team leader (hereinafter “the Leader”).
In any case, “the Leader” must inform the members of the group of “Travelers” he represents, about the details of the “Luxury Private Tours” and about these “General Terms of Participation”. It should therefore be emphasized that acceptance of these “Terms of Participation” by “the Leader” of the group is binding on both “the Leader” and the members of the group he represents, in respect of the form, content, details and terms of participation for each “Luxury Private Tour”, he may choose.
“Sale Prices” for “Luxury Private Tours” are pre-determined and depend on the number of participants.
“Travellers” will be informed about the program, routes and costs of the “Luxury Private Tour” by visiting the website of the “Company” and the form that will be sent through the “Company”, where they will also be informed about the possibility of completing the reservation. through payment by bank transfer or credit card.
Small Group Tours
The “Small Group Tours” are organized tours both to known, but mainly to unknown places on the Island of Corfu, related to culture, traditions, folklore, customs, unique local products, or the daily life of the local people. The purpose of the “Small Group Tours” is for the “Travelers” to experience from close all the above, not only to learn about them but also to participate actively.
“Small Group Tours” are tours organized by the “Company” with a predetermined itinerary, duration, and ticket price. The “Small Group Tours” can be attended by all interested visitors to Corfu, regardless of their place of residence, each paying the cost of participation. The meeting point of the “Small Group Tours” is usually the port of Corfu, in the center of the city of Corfu or wherever else is specified in the “Small Group Tours” posted on the website of the “Company”.
Luxury Private Tours & Small Group Tours
The “Tours” are luxurious, designed to provide the Travelers authentic moments from the hidden diamonds of Corfu with the least possible inconvenience.
The “Tours” are described in detail on the website of “The Corfu Experience”, www.thecorfuexperience.com as well as in the publications of the “Company” they shall apply for the period of time that is explicitly mentioned therein, and according to the particular terms and conditions set out therein.
Any changes, corrections and information about the “Tours” shall become binding after they have been published or announced and will apply to all “Travelers”.
“Tours” may also depend on conditions and factors beyond the control of the “Company” and might therefore be subject to modifications.
In any such case, the “Company” will make every effort to inform the “Travelers” within due time by any means of communication they wish, i.e., by email or phone call. The “Travelers” are therefore obliged to make available to the “Company” their respective contact details.
CONDITIONS – PROCEDURE FOR PARTICIPATION IN THE “TOURS”
Participation in the “Tours” is allowed only to persons of legal age in Greece, i.e., aged eighteen (18) years and older or to minors provided that they are accompanied by at least one (1) of the persons who have parental or responsibility or custody for these minors.
The participation of the “Travelers” and the reservation of any “Tour” as well as the commitment of the respective date, is made only through the website of the «Company»,(www.thecorfuexperience.com) provided that that all of the following conditions are met:
*Any bookings by the “Travelers” for “Tours” must have been duly submitted, following the instructions described on this website.
*” The Travelers” must have paid to the “Company” by bank transfer the full deposit for the “Tour” they have booked, in accordance with the instructions described on this website.
* The Terms of Participation herein must have been accepted and unconditionally complied with.
Bookings by “Travelers” for any “Tour” can be made any time. However, for reasons of better management and organization, as well as for reasons related to their availability, the “Company” suggests the participants to complete the reservation form of the “Tour” and the date they have chosen.
PRICES
All prices are posted in detail on this website, separately for each one of the “Tour” they include only those services that are explicitly mentioned.
The price for participation in any of each of the “Tours” (hereinafter referred to as the “Selling Price”) must be indicated in the price list of the “Company” that will be in force at that time.
The “Selling Price” is listed on this website, is different for each one of the “Tours”. In “Tours” people aged 12 and over have a charge with the listed participation price (full price), while children up to 12 years have a 50% discount on the listed participation price.
If requested by the “Travelers”, during their “Tour” or before the end of, the “Tour’s” duration may be extended, under the basic condition that this extension is possible; in such a case there will be an extra charge of 300 (three hundred) Euros for every additional hour, regardless of the number of participants. In this case, the participants acknowledge and accept this extra charge as a reasonable and fair remuneration of the “Company”.
It should be pointed out that the “Selling price”, on the basis of which the participants proceeded to book any of the “Tours”, will not change in any case and for any reason, regardless of any changes to the conditions affecting the original “Selling price”.
Apart from this, the “Company” generally reserves the right to adjust from time to time the “Selling prices” of the “Tours”. For the reservation of any of the “Tours” by the “Travelers” the “Selling price” posted on this website on the day of the reservation shall apply.
PAYMENT POLICY
The reservation of an “Luxury Private Tour” by the participants or their “Leader’, is to be finalized with the payment of the deposit to the “Company”, which amounts to 30% (thirty percent) of the total cost. The total cost will be calculated upon selection of the total duration of the “Tour” and declaration of the total number of participants.
The booking of a ‘Luxury Private Tour’ is only valid when the full amount of the deposit has been transferred to the ‘Company’ by the participants or their ‘Leader’.
The reservation of each “Small Group Tour” by the “Travelers”, is finalized with the deposit of the full payment to the “Company”, equal to 100% (one hundred percent) of the total cost, which will arise after the declaration of total number of participating “Travelers”.
The receipt of the bank transfer stating the details of the 2 (two) parties, is also a temporary receipt for the payment of the above amount by the Company and must be printed and kept for record purposes.
If you pay by credit card, the reservation can be automatically canceled without giving any notice to the “Traveler”, in case the credit card has no balance, or access has been denied or the card has expired.
Payment of the outstanding amount of the “Luxury Private Tour” is made at the beginning, at the meeting point, in cash or by credit or debit card.
OBLIGATIONS & RESPONSIBILITIES OF THE PARTICIPANTS
All participants are required, during the “Tours”, to have with them and show, on request of the “Company” or any interested Officials of the State, their National Identity Card (ID Card) or their Passport or any other officially recognized official documents. The documents for the identification of minors must state explicitly their date of birth.
At the beginning of the “Tour”, all the “Travelers” must have their passports available to complete the – required by law – boarding list and confirm that they have been informed and accepted the Terms and Conditions, which are posted on the “Company” website.
“The Travelers “are always required to behave in a socially acceptable manner, to show understanding and comply with the instructions of the tour guides, as well as to conform with the rules in force at the places and areas they visit.
During the “Tours”, the participants must be extremely careful with the findings and objects displayed, as well as with any other objects to be found at the places they visit, as well as to respect and fully comply with all special conditions applying according to the case. The “Company” will inform the participants about any special conditions in detail and within due time.
All “Travelers” must fully comply with the schedule of the “Tour”, the instructions of the tour guides or escorts and the “Company’s” representatives, as well as to arrive at the meeting point on time, so that the time schedules of the tours, visits, or lessons forming part of the program of their “Tour” are adhered to.
The participants must supervise the minors in their group continuously, throughout the “Tour”, in respect of their safety and behavior. It is explicitly agreed that they are liable for the acts of all minors they are accompanying. The participants shall be liable to compensate the “Company” in full for any losses (including any possible loss of profits) the “Company” shall incur due to acts or omissions of the minors any time during the “Tour”.
In case one or more participants have a health problem, allergy, or intolerance to a food, they must inform the Company, to take the necessary measures for their protection. It is explicitly agreed that if the Company has not received any notice or information about the existence of such a problem, the “Company” shall not bear any responsibility, in case any unforeseen problems might arise for the above reasons.
OBLIGATIONS OF “THE CORFU EXPERIENCE” – DETERMINATION OF THE LIABILITY
The suggestions included in each particular “Tour” are the result of a long and intensive search by the team of our local experts; the descriptions of the suggested places correspond fully to reality.
To organize the “Tours”, the “Company” works together with a few suppliers, partners, site owners, producers, etc. (hereinafter referred to as the “Third Parties”). The “Company” undertakes the obligation to coordinate and carry out the “Tour” in the best possible way, acting as coordinator between the participants and any “Third parties” providing services of any kind and will make every effort to meet the expectations of the participants.
In respect of the points of visit referred to in the program of each “Tour”, it should be pointed out that these places do not belong to the “Company” and therefore, if the “Third Party” do no more offer the possibility to visit or leading through these points without notice, by fault of the “Third Party” concerned, the “Company’ will be forced to change the program of the “Tour”, in order to provide the best service to the participants; the “Company’ can in no case be considered liable for this change.
The “Tours” are designed in such a way that the participants shall not feel physical fatigue at any time; however, it should be made clear and accepted that in some cases gentle and short walks under the sun are required. If during the “Tour” any of the participating participants feel tired for any reason, then the “Company” escorting staff will take care of, aiming mainly at the ultimate safety of participants, even if this presupposes a respective delay in the “Tour” program.
It should also be pointed out that participants of “Tours” accept the – minimum – degree of danger involved in some of the activities they have chosen and declare explicitly that they share liability for participating in them and will not seek any liability or compensation from the “Company” in the event of any minor accident caused by their own carelessness or fault.
All “Tours” comprise the consumption of food and drink by participants, at specific places visited or during a cooking class. For this reason, participants must inform the “Company”, at their own risk, within due time, of any problems of intolerance or allergy to certain substances or foods, in order to avoid their use.
In the event that the Company does not receive such information, participants explicitly declare that the “Company” has no liability; they also expressly state that they will not seek any liability or compensation from the “Company” in the event of any health problem arising therefrom to one of the participants.
By a great sense of high responsibility and keeping in mind the safety of the participants, the “Company” has entered into a cooperation agreement with a Medical Centre; this contract is limited to the necessary remote instructions only, in order to provide first aid and best deal with any unforeseen health problems during an “Tour”.
The” Company” has organized the whole program that includes each “Tour” in a strictly methodical and complete manner, but the “Company” is not able to predict or influence situations that are beyond its control, which might lead to cancellation or modification of specific services, activities and visits that form part of each “Tour” or might cause damages due to non-execution or incomplete execution of the agreed services. Such cases include for example: weather conditions, strikes, events, accidents, earthquakes, fires, restrictions imposed in certain areas or any other type of emergency. Consequently, the participants recognize and accept the above as correct, reasonable, and fair and waive any of their rights to request compensation by the “Company” if such an event occurs. In such cases the liability of the “Company” is strictly limited to proven omissions and lack of organization due to deceit or gross negligence. In any of the above cases, the “Company” will make every effort to ensure the continuation and completion of each “Tour”, without, however, being held liable in any way.
Furthermore, in such cases, the “Company” cannot be held liable for compensation for any damages any participant might incur due to the above reasons. The “Company” will make every effort to assist participants in any way, but this does not make the “Company” responsible or liable to cover any relevant additional costs, which will have to be covered, as in cases of force majeure, by the participants themselves.
The participants should report any complaints to the representative of the “Company” immediately and on the spot, during the realization of any “Tour”. If the issue reported cannot be resolved on the spot, the participant must submit such a complaint to the Company in writing, within 5 (five) working days from the date of the “Tour”, together with any documents or other evidence. After the expiration of the above deadline, the “Company” is not liable to any requests for compensation. In any case, any compensation by the “Company” due to failure to provide any kind of service or any “Tour”, may not exceed the value of each service or “Tour” itself respectively.
OFFERS AND DISCOUNTS
For a certain period, the “Company” may offer specific “Tour” at preferential prices or discounts, under special circumstances, terms, or conditions. Any such offer from the “Company” does not allow other participants who do not fall under these conditions or in the specific time, to claim a similar discount or cancel their reservation for this reason.
ACCOMPLISHMENT OF THE “TOURS”
The “Company” will make every effort to fully respect the exact program of each “Tour”, as mentioned on this website or the schedule that “Travelers” are going to receive. The “Company” may, however, may make changes to the itinerary or schedule, to the extent the “Company” considers appropriate, in order to overcome technical problems or unforeseen difficulties, provided that the “Company” has informed the participants within due time. The same applies to changes in the program on the part of participants, if they believe that these changes will improve the quality of their “Tour”, under the basic condition that implementation of these changes is feasible.
The “Company” may photograph or videotape parts of or entire “Tour” for archival or advertising purposes, subject to the strict consent and permission of the participants. If any do not wish to appear in photos or videos, they must notify the “Company’s” tour guides.
The “Company” will always take all necessary measures to protect the privacy of minors and will never use photos or videos of minors without the consent of their parents or their legal custodians.
GENERAL INFORMATION
- It should be pointed out that during the summer months the weather in Corfu shows small fluctuations, depending on the season. Normally, the highest temperatures in May reach 28-30⁰ C, in June 30-32⁰ C, in July and August 32-35⁰ C, in September 30-32⁰ C and in October 26-28⁰ C.
The participants are responsible to obtain information by the local media or via the internet about the weather conditions that will prevail on the day they chose to do their ‘Tour” and to assure themselves that they have the appropriate clothes.
2.The “Tours” include gentle walking, leisurely walks or strolls on paved or cobbled roads. For this reason, the “Company” recommends the participants to wear comfortable sports shoes.
3.The “Tours” include visits to some parts of Corfu, where the road network has turns. For these destinations the “Company” has chosen (as much as possible) the safest and most relaxing routes even if the travel time is a few minutes longer.
INSURANCE
All “Tours” have been carefully scheduled by our local experts, with a high sense of responsibility, for the participants to enjoy their tour safely. From the very first moment of each “Tour” to the moment of return to the designated point, all participants are fully protected by an indemnity and civil liability insurance against any unexpected events.
The “Company” has provided a specific insurance policy for groups with professional liability against third parties, which covers cases of liability to participants resulting from non-performance or improper fulfillment of the “Company’s” obligations, as described. The insurance policy also covers insolvency and bankruptcy, as well as the obligation to refund the amounts paid by the participants. The insurance policy number and the details of the insurance company are at the disposal of every interested participant.
The “Company” in order to provide full insurance coverage to the “Travelers”, is obliged to send to the insurance agency, before the start of each “Tour”, the corresponding list of participants, in which the personal identity details of each participant are listed: Name, surname, nationality, passport number or national identity number. In case a “Traveler” does not wish to declare the above information in the list of participants, then the insurance agency does not recognize the participation of this “Traveler” in the “Tour” and will not cover any request for compensation of the “Traveler” in case of any event that occurs during the “Tour”.
By accepting the present Terms and Conditions, every “Traveler” clearly accepts that if for any reason he has not stated his personal identity details (which are proof of his participation) in the list of participants in the “Tour”, then he is not entitled to submit a request or claim any compensation in the event of any incident occurring during the “Tour” and waive that claim permanently.
CANCELLATION POLICY
The reservation of each “Tour” for a specific – unique – date, presupposes the commitment by the “Company” to provide a luxury bus or yacht, a driver – skipper, a tour guide, and a number of associates who shall provide their services as well as hospitality in their areas.
In order to perfectly organize and offer the services described and in order to successfully complete each “Tour”, the “Company” pays all associates and suppliers significant amounts in advance; the “Company” also undertakes specific obligations to compensate the participants in case of cancellation for the entire price or a part thereof.
Therefore, in case of a cancellation charges shall apply, which depend on the date the cancellation was made.
*LUXURY PRIVATE TOURS – CANCELLATION POLICY
1)At the request of the “Participants”, the date of each “Tour” can be changed without any additional charge, under the general condition that the written request of the “Participants”, to change the date is communicated to the “Company” at least 7 (seven) calendar days before the initial agreement date. On this case customers must select the new available date they wish to take their “Tour” from the calendar on this website. If there are no other dates available, or if the written notice of postponement to the “Company” is given by the “Participants”, in less than 7 (seven) calendar days, then the total amount of the advance payment already paid will be withheld.
2) In case of final cancellation of the “Tour” booked by the participants, through their own fault, no penalty is imposed, provided that the cancellation is announced in writing to the “Company” at least 7 (seven) calendar days before the agreed date. If this cancellation is notified in less than 7 (seven) calendar days, then the full amount of the deposit already paid will be retained by the “Company”.
3)If, for any reason, there will be an interruption or final cancellation during an ”Tour”, by fault of the “Participants”, then there is no reason for a refund of the money.
4)If, for any reason, there will be an interruption or final cancellation during an “Tour”, by fault of the “Company”, then the “Participants” will be refunded in full.
5)If, during an “Tour”, there will be an interruption or permanent cancellation by reason of force majeure (e.g. weather conditions, strike, events, accidents, earthquakes, fire, restrictions imposed by the government in certain areas or for any other type Emergency), then the “Participants” will receive a partial refund of their money, less the expenses already paid (if applicable) for benefits or services already performed, before the termination or final cancellation of the “Tour”.
6)In case of any possible delay in the flow or program of an “Tour”, by fault of the “Company” or due to force majeure, the program will continue and be completed normally, and this delay will not change or burden the agreed costs.
* SMALL GROUP TOURS – CANCELLATION POLICY
The reservation of each “Small Group Tour” for a specific – unique – date, presupposes the commitment by the “Company” to provide a luxury bus, a driver, a tour guide, and a few associates who shall provide their services as well as hospitality in their areas.
In order to perfectly organize and offer the services described and in order to successfully complete each “Tour”, the “Company” pays all associates and suppliers significant amounts in advance; the “Company” also undertakes specific obligations to compensate the participants in case of cancellation for the entire price or a part thereof.
Therefore, in case of a cancellation charges shall apply, which depend on the date the cancellation was made.
1)Cancellation more than 5 calendar days before the start of services: There is no cancellation fee, you will receive a full refund.
2)Cancellation between 4 and 2 calendar days before the start of services : You will be charged a 50% cancellation fee.
3)Cancellation less than 2 calendar days or less before the start of services: you will be charged a 100% cancellation fee.
4)If, for any reason, there is a permanent cancellation of a “Tour”, through the fault of the “Company”, then the participants will be fully refunded.
5)If, during an “Tour”, there will be an interruption or permanent cancellation by reason of force majeure (e.g. weather conditions, strike, events, accidents, earthquakes, fire, restrictions imposed by the government in certain areas or for any other type Emergency), then the participants will receive a partial refund of their money, less the expenses already paid (if applicable) for benefits or services already performed, before the termination or final cancellation of the “Tour”.
6)In case that a “Traveller” is delayed in arriving at the meeting point due to his own fault, resulting in the departure of the bus, then there is no reason for a refund.
BAGGAGE – PERSONAL ITEMS
The participants are solely responsible for the care of their luggage or personal belongings; regardless of their presence, the representatives of “Company” will not be liable for any loss or damage to the luggage of the participants and the contents thereof.
COVID 19.
In accordance with the Greek legislation and the regulations that were established for the prevention of the spread of the pandemic caused by COVID 19 and the protection of public health, but also our increased corporate responsibility, we certify that:
* All members of our team are fully vaccinated
* All members of our team take a PCR Test every 3 days.
*Before the start and at all scheduled stops of each “Tour” our bus is disinfected.
* All members of our team constantly wear protective masks and disinfect their hands with antiseptic.
* We always keep the required distances.
* We constantly check observance of the protection measures in the visited places and avoid visits at rush hours.
The safety of our team and our travelers is our priority.
PERSONAL DATA PROTECTION
The “Company” undertakes not to sell in any way or transfer, not to grant access and also not to disclose the personal data of the participants or visitors to its website (www.thecorfuexperience.com) without their consent, except to any third parties and service providers directly related to the implementation and execution of the “Tours” and in cases foreseen by the law in force. The “Company” may process part, or all of the data disclosed by the users for statistical purposes and in order to improve the services and information provided. The participants accept and give their consent for the processing of their personal data contained on the pages of the “Company’s” website, as well as for the transfer of this data to third parties and service providers related only to the realization and successful completion of the” Tours”. The personal data disclosed by the users of the “Company’s” website will be used exclusively to ensure the realization and completion of the services and may not be used by anyone, without observing the provisions of Law 2472/97 (Protection of the Person from the Processing of Personal Data). The “Company” does not control and bears no responsibility for the protection of personal data from other websites and any websites the “Company” refers to through hyperlinks or banner ads that may appear on the “Company’s” website. For any problems that occur during their visit, the users should report directly to the respective administrators of these websites.
SETTLEMENT OF DISPUTES AND APPLICABLE LAW
In accordance with the “Company’s” philosophy, we will always try to settle amicably any disputes that might arise in conjunction with the interpretation of these Terms and Conditions, as well as any other issues that might arise from the participation of the clients in the “Tours”.
The agreement between the “Company” and the participants will always be governed by Greek Law. In case an amicable settlement of the disputes is not possible, they resolution of the disputes are subject to the jurisdiction of the Athens Courts.
